Do you have to tell users they are talking to an AI chatbot?

Yes, in a growing number of places. If your site uses an AI chatbot or assistant, you must disclose that a person is interacting with AI. This is required under the EU AI Act (Article 50(1), from 2 August 2026) and under laws in Utah, New York, Texas, and South Korea. The notice must be clear and shown at the start of the interaction.

Where chatbot disclosure is required

  • European Union. Article 50(1) requires providers to inform people that they are interacting with an AI system, unless it is obvious.
  • Utah. Disclosure on a clear request, and proactively in high-risk interactions that collect sensitive data and give advice on significant decisions.
  • New York. AI companion models must disclose at the start and at least every three hours of continued interaction.
  • Texas. Government agencies and healthcare providers must disclose AI interaction to consumers.
  • South Korea. Operators must notify users in advance that AI is in use.
